THE BOROUGH OF ST. CLAIR.

Ordinance No. 85.

AN ORDINANCE AUTHORIZING THE WIDENING AND OPENING OF ENGSTLER STREET FROM MEYER STREET TO IHMSEN STREET, AND PROVIDING FOR THE ASSESSMENT OF DAMAGES CAUSED BY THE SAME.

WHEREAS, It appears by the petition and affidavit on file in the office of the Borough Secretary that a majority of the property owners in interest and number abutting upon the line of Engstler Street from Meyer Street to Ihmsen Street, have petitioned the Council of the Borough of St. Clair to enact an ordinance authorizing the widening and opening of the same; and

WHEREAS, Notice has heretofore been given in the manner required by law of a proposition to widen and open said Engstler Street between the points mentioned, and a hearing had thereon.

SECTION 1. Be it ordained and enacted by the Town Council of the Borough of St. Clair, and it is hereby ordained and enacted by and with the authority of the same, That Engstler Street from Meyer Street to Ihmsen Street be widened and opened to the width of forty (40) feet. That Engstler Street between the above mentioned points is now fifteen (15) feet wide as dedicated in the plan of Frank Engstler Estate, and the ground required for the purpose of said widening and opening to be taken from the abutting properties on the east and west sides of said Engstler Street:—a strip of ground five (5) feet in width to be taken from the properties on the easterly side of said Engstler Street between Meyer Street and Ihmsen Street, and a strip of ground twenty (20) feet in width to be taken from the properties on the westerly side of said Engstler Street between Meyer Street and Ihmsen Street, making Engstler Street a uniform width of forty (40) feet between the points mentioned herein.

SECTION 2. The Borough Engineer and Street Committee are hereby authorized and directed to cause said Engstler Street to be surveyed, widened and opened to the width shown in Section 1, of this Ordinance.

SECTION 3. The damages caused thereby and the benefits to pay the same to be assessed against and collected from the properties specially benefitted in accordance with the provisions of the Acts of Assembly relating thereto and regulating the same; and particularly under 'An Act in relation to the laying out, opening, widening, straightening, extending or vacating streets, alleys, etc., providing for the ascertaining of damages to private property resulting therefrom, and the assessment of damages, costs and expenses upon property benefitted,'—approved May 16th, 1891, and the supplements thereto.

SECTION 4. That any ordinance or part of ordinance conflicting with the provisions of this ordinance be and the same is hereby repealed so far as the same affects this ordinance.

Ordained and enacted into a law this 4th day of June, A. D. 1913.
