AN ORDINANCE—Authorizing the Mayor, and the Director of the Department of Public Works, for and on behalf of the City of Pittsburgh to enter into an agreement with Urban Redevelopment Authority of Pittsburgh providing for the construction of a street by the Authority in the 12th Ward, and the dedication of the street to and acceptance and dedication by the City of Pittsburgh.

Whereas, the Urban Redevelopment Authority of Pittsburgh is presently undertaking an industrial development in the 12th Ward of the City of Pittsburgh, known as the Penn–Dahlem area, financed by the Industrial Land Reserve Fund.

NOW, THEREFORE,

The Council of the City of Pittsburgh hereby enacts as follows:

Section 1. That the Mayor and the Director of the Department of Public Works be and they are hereby authorized and directed to enter into an Agreement in a form to be approved by the City Solicitor, for and on behalf of the City of Pittsburgh with the Urban Redevelopment Authority of Pittsburgh (hereinafter referred to as the "Authority") containing in substance the following terms:

  1. Authority agrees to construct a new street in compliance with City of Pittsburgh standards from Dahlem Street eastwardly along the northerly line of National Biscuit Company's property, and upon completion of construction thereof to dedicate the street to the City of Pittsburgh, and the City of Pittsburgh agrees to accept the dedication thereof.
  2. The Authority agrees to apply funds out of the Industrial Land Reserve Fund in accordance with the provisions of the Cooperation Agreement, dated December 14, 1964 to pay the cost of constructing the aforesaid street.
  3. The City of Pittsburgh hereby agrees to defend and hold harmless the Authority from any liabilities, claims and suits at law or in equity arising in any way from the construction of the said street after the date of acceptance of the street by the City of Pittsburgh as established by Ordinance.

Section 2. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed so far as the same effects [sic] this Ordinance.
