AN ORDINANCE—Vacating Anchor Way, from DeSoto Street to a line 237.365 feet east of Lothrop Street, abondoning [sic] the City sewer and water line on Anchor Way, between said terminals, and providing certain terms and conditions.

WHEREAS, It appears by the petition and affidavit on file in the Office of the City Clerk that the Children's Hospital of Pittsburgh, owner of all the property fronting or abutting on Anchor Way, from DeSoto Street to a line 237.365 feet east of Lothrop Street, has petitioned the Council of the City of Pittsburgh to enact an Ordinance for the vacation of the same, therefore

The Council of the City of Pittsburgh hereby enacts as follows:

Section 1. That Anchor Way, from De Soto Street to a line 237.365 feet east of Lothrop Street, be and the same is hereby vacated and, in connection therewith, the City sewer and water line on Anchor Way, between said terminals, is hereby abandoned, all of the foregoing on the following terms and conditions to be accepted by Children's Hospital of Pittsburgh, for itself, its successors and assigns, before said vacation and abandonment shall become effective. The line 237.365 feet east of Lothrop Street is the easterly terminus of the vacation of a portion of Anchor Way by Ordinance No. 716, approved November 9, 1929.

(a) Children's Hospital of Pittsburgh, for itself, its sucessors [sic] and assigns, specifically waives any claims for damages by reason of the abandonment of the City sewer and water line on Anchor Way between said terminals.

(b) Children's Hospital of Pittsburgh, for itself, its successors and assigns, agrees within sixty (60) days from the passage and final approval of this Ordinance to file with the City Controller an acceptance of the terms and conditions hereof, said acceptance being duly authorized by the proper officials of the Children's Hospital of Pittsburgh, and upon failure to file such acceptance within sixty (60) days from the passage and final approval of this Ordinance, the same shall be void and of no effect.

Section 2. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed so far as the same affects this Ordinance.
