AN ORDINANCE—Accepting the dedication of Darlington court from Darlington road to the easterly terminus, as laid out in "Darlington Gardens Plan of Lots" in the Fourteenth Ward of the City of Pittsburgh by Jacob H. [sic] Simon, Selda Simon, Morris Rosenstein, and Sophie Rosenstein for public highway purposes, opening and naming the same, fixing the width and position of the sidewalks and roadway thereof with provision for slopes, landscaping, retaining walls, and steps, establishing the grade thereof, and accepting the grading, paving, curbing and sewering of the same.

Whereas, Jacob W. Simon, Selda Simon, Morris Rosenstein, and Sophie Rosenstein, the owners of certain property in the Fourteenth Ward of the City of Pittsburgh, laid out in "Darlington Gardens Plan of Lots," of record in the Recorder's Office of Allegheny County in Plan Book Volume 47 Page 168, have located a certain street thereon and executed a certain Deed of Dedication on said Plan for all ground covered by said street to said City for public highway purposes, and,

Whereas, Jacob W. Simon, Selda Simon, Morris Rosenstein, and Sophie Rosenstein have graded, paved, curbed and sewered the above mentioned street between the above mentioned terminals at their own cost and expense, and,

Whereas, It is desired that the City of Pittsburgh accept said street and improvement as part of the City's system of improved highways; Therefore,

The Council of the City of Pittsburgh hereby enacts as follows:

Section 1. That the dedication of Darlington court, from Darlington road to the easterly terminus, as laid out in "Darlington Gardens Plan of Lots" in the Fourteenth Ward of the City of Pittsburgh by Jacob W. Simon, Selda Simon, Morris Rosenstein and Sophie Rosenstein in June, 1951, shall be and the same is hereby accepted.

Section 2. Darlington court, from Darlington road to the easterly terminus, as aforesaid dedicated to said City for public highway purposes, shall be and the same is hereby opened as a public highway and is hereby named "Darlington Court."

Section 3. The width and position of the sidewalks and roadway, with provision for slopes, landscaping, retaining walls and steps, shall be and the same are hereby fixed as follows, to-wit:—

The curb lines shall be parallel to and 12.0 feet inside the respective street lines.

The sidewalks shall have a uniform width of 6.0 feet, lying outside of and contiguous to the above described curb lines.

The roadway, from Darlington road to point of curve 39.07 feet east of the dividing line between Lot No. 3 and Lot No. 19, shall have a uniform width of 26.0 feet and shall occupy that portion of the street lying between the above described curb lines; thence to the easterly terminus shall have a variable width, with a minimum of 22.0 feet, and shall occupy the portion of the street lying between the above described curb lines and the traffic island as now constructed.

The remaining portions of the street, lying without the lines of the sidewalks, roadway and traffic island, as above described, shall be used for slopes, landscaping, retaining walls and steps.

Section 4. The grade of the northerly and easterly curb line shall be and the same is hereby established to conform to the grade of the street as now improved, as follows, to-wit:—

Beginning at the easterly curb line of Darlington road at an elevation of 1089.59 feet, as at present improved; thence falling and rising by a concave parabolic curve, having an apex elevation of 1090.14 feet, for a distance of 40.0 feet to a point of tangent to an elevation of 1091.06 feet; thence rising at the rate of 4.62 per cent for a distance of 171.0 feet to a point of curve to an elevation of 1098.97 feet; thence by a convex parabolic curve for a distance of 40.0 feet to a point of tangent to an elevation of 1100.09 feet; thence rising at the rate of 1.0 per cent for a distance of 144.75 feet to a point of curve to an elevation of 1101.54 feet; thence by a convex parabolic curve for a distance of 50.0 feet to the middle point of a convex parabolic curve, which would have a total length of 100.0 feet and an apex elevation of 1102.04 feet, to an elevation of 1101.79 feet, said last mentioned point being at the horizontal point of curve on the east curb line perpendicularly opposite the point of curve on the easterly street line distant 8.23 feet northwardly from the dividing line betwen Lot No. 13 and Lot No. 14.

Section 5. The grading, paving, curbing and sewering of Darlington court, from Darlington road to the easterly terminus, shall be and the same are hereby accepted and declared to be public improvements of the City of Pittsburgh.

Section 6. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed so far as the same affects this Ordinance.
