AN ORDINANCE — Taking over for maintenance Ohio River boulevard from Superior avenue to the McKees Rocks Bridge Traffic Circle, and from the Traffic Circle to the dividing line between the City of Pittsburgh and the Borough of Bellevue, and the Termon Avenue Approach from the Traffic Circle to California avenue, and taking over the Termon Avenue Approach as a City street.

Whereas, The City of Pittsburgh entered into an Agreement with the County of Allegheny dated October 11, 1949, by authority of Ordinance No. 363, approved August 1, 1949, pertaining in part to the Ohio River boulevard, the Termon Avenue Approach and the McKees Rocks Bridge Traffic Circle, and

Whereas, Said Agreement shall not become effective in any of its provisions until such time as the City of Pittsburgh has passed all the necessary and required ordinances under this Agreement and certified copies of the same shall have been filed with the County of Allegheny, and,

Whereas, By Agreement dated October 28, 1930, by authority of Ordinance No. 411, approved September 27, 1930, the City of Pittsburgh has already agreed with the County of Allegheny to maintain and keep in good repair California avenue, (inadvertantly [sic] called Ohio River boulevard in the said Agreement and said Ordinance) excepting curb and sidewalks, from a point 15 feet northwest of Atmore street to the westerly line of Superior avenue, any further agreement or ordinance concerning maintenance of that portion of California avenue is deemed unnecessary; Now, Therefore,

The Council of the City of Pittsburgh hereby enacts as follows:

Section 1. That those two portions of Ohio River boulevard within the limits of the City of Pittsburgh, not including the McKees Rocks Bridge Traffic Circle, one portion extending from the westerly line of Superior avenue to the easterly intersection of the Traffic Circle near the intersection of Wortman and Florida streets, and the other portion extending from the westerly intersection of the Traffic Circle at the westerly line of Davis avenue to the dividing line between the City of Pittsburgh and the Borough of Bellevue, and the Termon Avenue Approach from the northerly intersection fo the Traffic Circle, at Station 60+15.50 as shown on County Plans File No. 399, to California avenue, at Station 71+88.60 thereon, shall be and the same are hereby taken over for maintenance, the same consisting of maintaining and keeping in good repair the Ohio River boulevard and the Termon Avenue Approach, including lighting, bridge structures, overhead foot bridges, curbs, sidewalks, retaining walls, storm water drainage system and slopes.

The County of Allegheny shall be forever afterwards relieved of any responsibility whatsoever for the maintenance and repair fo the Ohio River boulevard and of the Termon Avenue Approach and the City of Pittsburgh shall be forever afterwards relieved of any responsibility whatsoever for the maintenance and repair of the McKees Rocks Bridge Traffic Circle.

Section 2. The Termon Avenue Approach from the northerly intersection of the Traffic Circle at Station 69+15.50 to California avenue at Station 71+88.60 shall be and the same is hereby taken over as a street in the Public Street System of the City of Pittsburgh, subject to the vacation of the same by petition to the Court of Quarter Sessions by the County of Allegheny, and with the City of Pittsburgh joining in the prayer of said petition.

Section 3. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed so far as the same affects this Ordinance.
