AN ORDINANCE—Vacating South 34th street from Carson street east to the northerly line of the right-of-way of Pittsburgh, McKeesport and Youghiogheny Railroad, abandoning the existing six inch cast iron water line and reserving to the City the right to enter upon said South Thirty-fourth street after the vacation and providing certain terms and conditions.

Whereas, Upon vacation of South Thirty-fourth street between said points, the City no longer desires to maintain the existing six inch cast iron water line located on said street, now therefore,

The Council of the City of Pittsburgh hereby enacts as follows:

Section 1. That South Thirty-fourth street from Carson street east to the northerly line of the right-of-way of Pittsburgh, McKeesport and Youghiogheny Railroad, shall be and the same is hereby vacated.

Section 2. The existing six inch cast iron water line of the City of Pittsburgh, located on said South Thirty-fourth street between said points is hereby abandoned.

Section 3. The vacation of South Thirty-fourth street between Carson street east and the northerly line of McClurg street is made upon the following terms and conditions to be accepted by the Urban Redevelopment Authority of Pittsburgh and Jones & Laughlin Steel Corporation for themselves, their successors and assigns, before said vacation and abandonment shall become effective.

(a) The City of Pittsburgh reserves the right and privilege to enter upon the land within the lines of South Thirty-fourth street as vacated for the purpose of inspection, maintenance, repair, construction or reconstruction of the existing sewer or thirty-six inch water line and same as may be reconstructed.

(b) Urban Redevelopment Authority of Pittsburgh and Jones & Laughlin Steel Corporation for themselves, their successors and assigns agree to permit the City of Pittsburgh to have access over, across and through property of the said Authority and the said Steel Corporation so that the said City shall be able to inspect, maintain, repair, construct or reconstruct its sewer and water lines extending northwardly beyond South Thirty-fourth street as vacated.

(c) Jones & Laughlin Steel Corporation for itself, its successors and assigns agrees to encase with reinforced concrete the existing thirty-six inch water line and to reinforce the thirty-six inch two ring brick sewer located on South Thirty-fourth street as vacated in accordance with plans prepared by said Corporations. Said plans to be approved by the Director of the Department of Public Works, and all work to be done under the supervision and inspection of the Department of Public Works. After completion of the work the Department of Public Works is to be furnished copies of plans for permanent record.

(d) Jones & Laughlin Steel Corporation for itself, its successors and assigns, agrees to close to vehicular traffic, South Thirty-fourth street as vacated by the construction of curbing and sidewalks along Carson street east across the vacated street, and to provide adequate drainage facilities. All work to be done to the satisfaction of the Director of the Department of Public Works.

(e) Urban Redevelopment Authority of Pittsburgh and Jones & Laughlin Steel Corporation for themselves, their successors and assigns agree within sixty (60) days from the final passage and approval of this Ordinance to file with the City Controller an acceptance of the terms and conditions hereof, said acceptance being duly authorized by the Board of Directors of the said Urban Redevelopment Authority of Pittsburgh and Jones & Laughlin Steel Corporation, and upon failure to file such acceptance within sixty (60) days from the final passage and final approval of this Ordinance the same shall be void and of no effect.

Section 4. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed so far as the same affects this Ordinance.
