AN ORDINANCE—Approving the plan of lots called "TERRACE VILLAGE No. 1," in the Third and Fifth Wards of the City of Pittsburgh; accepting the dedication of KIRKPATRICK STREET, BENTLEY DRIVE, ELMORE STREET, ELMORE SQUARE, NIGH WAY and GROVE STREET, as shown therein, for public highway purposes; opening and naming the same; fixing the width and position of the sidewalks, roadways and automobile parking areas of BENTLEY DRIVE, ELMORE STREET, ELMORE SQUARE, NIGH WAY and GROVE STREET, and establishing the grades on KIRKPATRICK STREET, BENTLEY DRIVE, ELMORE STREET, ELMORE SQUARE, NIGH WAY and GROVE STREET.
WHEREAS, the Housing Authority of the City of Pittsburgh, the owner of certain property in the Third and Fifth Wards of the City of Pittsburgh, laid out in a plan of lots called "TERRACE VILLAGE No. 1," has located certain highways therein and executed a deed of dedication on said plan for all ground covered by said highways to the City of Pittsburgh, for public use for highway purposes, and has released the said City from any liability for damages occasioned by the physical grading of the said public highways to the grades hereinafter established; NOW, THEREFORE:
Section 1. Be it ordained and enacted by the City of Pittsburgh, in Council assembled, and it is hereby ordained and enacted by the authority of the same, That the plan of lots named "TERRACE VILLAGE No. 1," situate in the Third and Fifth Wards of the City of Pittsburgh, laid out by the Housing Authority of the City of Pittsburgh, in August, 1939, be and the same is hereby approved, and Kirkpatrick street, Bentley drive, Elmore street, Elmore square, Nigh way and Grove street as located and dedicated in said plan are hereby accepted.
Section 2. The highways as aforesaid dedicated to said City for public highway purposes shall be and the same are hereby appropriated and opened as public highways, and named "KIRKPATRICK STREET," "BENTLEY DRIVE," "ELMORE STREET," "ELMORE SQUARE," "NIGHT [sic] WAY" and "GROVE STREET."
Section 3. The width and position of the sidewalks, roadways and automobile parking areas of Bentley drive, Elmore street, Elmore square, Nigh way and Grove street, and the grades of Kirkpatrick street, Bentley drive, Elmore street, Elmore square, Nigh way and Grove street, laid out and dedicated in the plan of lots named "TERRACE VILLAGE No. 1," are hereby fixed and established as described in Ordinance No. 94, approved March 14, 1940, and of record in Ordinance Book Volume 50, page 560, and as amended by Ordinance No. 146, approved April 10, 1940, and of record in Ordinance Book Volume 50, page 606.
Section 4. The Department of Public Works of the City of Pittsburgh is hereby authorized and directed to enter upon, take possession of and appropriate the said Kirkpatrick street, Bentley drive, Elmore street, Elmore square, Nigh way and Grove street for public highway purposes, in conformity with the provisions of this Ordinance.
Section 5. That any Ordinance or part of Ordinance, conflicting with the provisions of this Ordinance, be and the same is hereby repealed, so far as the same affects this Ordinance.
