AN ORDINANCE—Vacating Dabbs avenue, Curran street, Tremont alley, Pallas alley, Biddle street, Notz alley, Lougeay avenue, Zeus alley, Rutter street and two unnamed highways as laid out and dedicated in the "Plan of the Sub-Division of the Estate of Phebe A. Phillips," in the Fourteenth (formerly Twenty-second) Ward of the City of Pittsburgh, approved February 24th, 1896.

Whereas it appears by the petition and affidavit on file in the office of the City Clerk, that all of the property owners fronting or abutting on the lines of Dabbs avenue, Curran street, Tremont alley, Pallas alley, Biddle street, Notz alley, Lougeay avenue, Zeus alley, Rutter street and two unnamed highways as laid out and dedicated in the "Plan of the Sub-Division of the Estate of Phebe A. Phillips," in Fourteenth (formerly Twenty-second) Ward of the City of Pittsburgh have petitioned the Council of the City of Pittsburgh to enact an ordinance for the vacation of the same, and

Whereas it appears that the said highways are unused and serve no public benefit or use whatsoever and that it would be to the general public interest to vacate the same, now therefore,

Section 1. Be it ordained and enacted by the City of Pittsburgh, in Council assembled, and it is hereby ordained and enacted by the authority of the same, That all of the streets, avenues, alleys and highways in a certain plan of lots, known as "Plan of the Sub-Division of the Estate of Phebe A. Phillips," in the Fourteenth Ward of the City of Pittsburgh, (formerly the Twenty-second Ward) approved February 24th, 1896 and being recorded in the Recorder's Office of Allegheny County in Plan Book Vol. 15, page 180, viz.:

All of that portion of unnamed highway within said plan extending from Dabbs avenue to southern boundary line of plan; Curran street extending from southern to northern boundary line of plan; Unnamed highway extending from Curran street in Partition Road; Subdivision line of Boyle, Irwin Estate, now known as Elwain street; Dabbs avenue, from eastern boundary line of Plan and Partition Road to Biddle street; Tremont alley, from Dabbs avenue to northern boundary line of Plan; Pallas alley, from southern boundary line of Plan to Biddle street; Biddle street, from Saline avenue to northern boundary line of plan; Notz alley, from Lougeay avenue to northern boundary line of plan; Zeus alley from Saline avenue to western boundary line of plan; Rutter street, from Saline avenue to western boundary line of plan be and the same are hereby vacated.

Section 2. That any ordinance or part of ordinance, conflicting with the provisions of this ordinance, be and the same is hereby repealed so far as the same affects this ordinance.
