AN ORDINANCE—Opening Monmouth street, in the Fourteenth ward of the City of Pittsburgh, from Nicholson street to Forward avenue, fixing the width and position of the sidewalks and roadway, establishing the grade thereof, and providing that the cost, damages and expenses occasioned thereby be assessed against and collected from properties benefited thereby.
Section 1. Be it ordained and enacted by the City of Pittsburgh, in Council assembled, and it is hereby ordained and enacted by the authority of the same, That Monmouth street, in the Fourteenth ward of the City of Pittsburgh, from Nicholson street to Forward avenue, be opened to a uniform width of fifty (50) feet, by taking for public use for highway purposes all the following described property, to-wit:
Beginning at a point on the southerly line of Nicholson stret, distant 313.79 feet westwardly from the westerly line of Beechwood boulevard; thence in a southerly direction 305.0 feet west of and parallel with the west line of Beechwood boulevard, for the distance of 770.82 feet to a point on the northerly line of Forward avenue; thence deflecting to the right 85° 22′ along the said northerly line of Forward avenue, for the distance of 44.04 feet to a point; thence deflecting to the right 9° 08′ and continuing along the said northerly line of Forward avenue, for the distance of 6.12 feet to a point; thence deflecting to the right 85° 30′ and in a northerly direction 355.0 feet west of and parallel with the west line of Beechwood boulevard, for the distance of 759.88 feet to a point on the southerly line of Nicholson street; thence deflecting to the right 74° 20′ and along the said southerly line of Nicholson street, for the distance of 51.93 feet to the place of beginning.
Section 2. The sidewalks shall each have a uniform width of thirteen (13) feet and shall lie along and parallel their respective building lines.
The roadway shall have a uniform width of twenty-four (24) feet and occupy the central portion of the street lying between the street lines as above described.
Section 3. The grade of the east curb line shall begin on the north curb line of Forward avenue, at an elevation of 383.05 feet; thence rising at the rate of 1 per cent. for the distance of 254.08 feet to a point of curve to an elevation of 385.59 feet; thence by a concave parabolic curve, for the distance of 80.0 feet to a point of tangent to an elevation of 389.31 feet; thence rising at the rate of 8.3 per cent. for the distance of 456.57 feet to the southerly curb line of Nicholson street to an elevation of 427.21 feet.
Section 4. The Department of Public Works is hereby authorized and directed to cause said Monmouth street, from Nicholson street to Forward avenue to be opened, in conformity with the provisions of Section 1 of this Ordinance.
Section 5. The cost, damages and expenses caused thereby, and the benefits to pay the same, shall be assessed against and collected from properties benefited thereby, in accordance with the provisions of the Acts of Assembly of the Commonwealth of Pennsylvania relating thereto and regulating the same.
Section 6. That any Ordinance or part of Ordinance conflicting with the provisions of this Ordinance be and the same is hereby repealed so far as the same affects this Ordinance.
