AN ORDINANCE—Accepting the dedication of certain property, in the Fourteenth ward of the City of Pittsburgh, for public use for highway purposes, opening and naming the same "Banbridge way" and establishing the grade thereof.

Whereas, Clara B. McCombs, widow, of the City of Pittsburgh, County of Allegheny and State of Pennsylvania, the owner of the property hereinafter described, has executed and delivered to the City of Pittsburgh, her certain deed of dedication, bearing date April 19, 1917, now on file in the Bureau of Engineering of said City, wherein she has conveyed said ground to said City, for a public highway and has released said City from any liabiliy [sic] for damages for or by reason of the physical grading of said public highway to the grade hereinafter established; therefore,

Section 1. Be it ordained and enacted by the City of Pittsburgh, in Council assembled, and it is hereby ordained and enacted by the authority of the same, That the said deed of dedication be and the same is hereby accepted, and the Bureau of Engineering is hereby authorized and directed to place the same of record in the office of the Recorder of Deeds in and for the County of Allegheny.

Section 2. The ground, so as aforesaid, conveyed to said City for public highway purposes, shall be and the same is hereby appropriated and opened as a public highway, in accordance with the terms of said deed of dedication and shall be known as "Banbridge way," the same being bounded and described as follows, to-wit:

Beginning on the easterly line of South Negley avenue, at the distance of 173.12 feet southwardly from the southerly line of Wilkins avenue; thence deflecting to the left 79° 06′ and in an easterly direction parallel with and 170 feet south from the southerly line of Wilkins avenue, for the distance of 414.97 feet, to a point; thence deflecting to the right 79° 06′ and in a southerly direction parallel with and 120 feet west from the westerly line of Murray avenue, for the distance of 173.83 feet to the northerly line of Solway street; thence deflecting to the right 100° 54′ and in a westerly direction along the said northerly line of Solway street, for the distance of 20.37 feet to a point; thence deflecting to the right 79° 06′, in a northerly direction parallel with and 140 feet west from the westerly line of Murray avenue, for the distance of 136.94 feet to a point of curve; thence deflecting to the west by the arc of a curve, having a central angle of 79° 06′ and a radius of 20 feet, for the distance of 27.61 feet to a point of tangent; thence in a westerly direction, by the tangent to the said surve [sic], parallel with and 190 feet south from the southerly line of Wilkins avenue, for the distance of 378.08 feet to the easterly line of South Negley avenue; thence deflecting to the right 79° 06′ and in a northerly direction along the said easterly line of South Negley avenue, for the distance of 20.37 feet to the place of beginning.

Section 3. The grade of said Banbridge way, from South Negley avenue to Solway street, is hereby established as follows, to-wit:

The grade of the south line shall begin on the east curb line of South Negley avenue, at an elevation of 354.87 feet; thence rising at the rate of 4.80 feet per 100 feet, for the distance of 388.27 feet to a point of curve to an elevation of 373.51 feet; thence by a convex parabolic curve, for a distance of 27.61 feet to a point of tangent to an elevation of 374.31 feet; thence rising at the rate of 1.0 foot per 100 feet, for a distance of 102.72 feet to a point of curve to an elevation of 375.34 feet; thence by a convex parabolic curve, for a distance of 44.40 feet to a point of tangent at the west curb line of Solway street to an elevation of 374.67 feet, curb as set.

Section 4. The Department of Public Works is hereby authorized and directed to enter upon, take possession of and appropriate the said described ground for a public highway, in conformity with the provisions of this Ordinance.

Section 5. That any Ordinance or part of Ordinance conflicting with the provisions of this Ordinance be and the same is hereby repealed, so far as the same affects this Ordinance.
