AN ORDINANCE—Opening Maple Heights road, from Fifth avenue through properties of George T. Oliver, Henry Aiken, Mary D. Oliver and Rebecca B. Berger, in the Fourteenth ward of the City of Pittsburgh, establishing the grade thereof and providing that the cost, damages and expenses occasioned thereby be assessed against and collected from properties benefited thereby.

Maple Heights road, from Fifth avenue through properties of George T. Oliver, Henry Aiken, Mary D. Oliver and Rebecca B. Berger, in the Fourteenth ward of the City of Pittsburgh, be opened to a variable width by taking all the following described property, to-wit:

Beginning at a point on the southerly line of Fifth avenue south 69° 52′ west and at a distance of 666.10 feet westwardly from the intersection of the westerly line of Negley avenue and the southerly line of Fifth avenue; thence south 23° 12′ east for a distance of 242.53 feet to a point of curve; thence by the arc of a circle having a central angle of 86° 04′ and a radius of 8.0 feet for the distance of 12.14 feet to a point of tangent; thence by a line tangent to said curve north 69° 52′ east for the distance of 35.67 feet to a point of curve; thence by the arc of a circle having a central angle of 35° 48′ and a radius of 92.4 feet for the distance of 57.73 feet to a point of tangent; thence by a line tangent to said curve south 74° 20′ east for the distance of 139.19 feet to a point of curve; thence by the arc of a circle having a central angle of 51° 09′ and a radius of 67.24 feet for the distance of 60.04 feet to a point of tangent; thence by a line tangent to said curve south 23° 11′ east for the distance of 57.17 feet to a point of curve; thence by the arc of a circle having a central angle of 93° 03′ and a radius of 79.30 feet for the distance of 128.77 feet to a point of tangent; thence by a line of tangent to said curve south 69° 52′ west for the distance of 147.42 feet to a point of curve; thence by the arc of a circle having a central angle of 15° 06′ 40″ and a radius of 546.0 feet for the distance of 144.0 feet to a point; thence north 23° 11′ west for the distance of 31.67 feet to a point; thence in an easterly direction by the arc of a circle having a central angle of 16° 12′ 36″ and a radius of 516.0 feet for the distance of 145.96 feet to a point of tangent; thence by a line tangent to said curve north 69° 52′ east for the distance of 147.42 feet to a point of curve; thence by the arc of a circle having a central angle of 93° 03′ and a radius of 49.30 feet for the distance of 80.06 feet to a point of tangent; thence by a line tangent to said curve north 23° 11′ west for the distance of 57.17 feet to a point of curve; thence by the arc of a circle having a central angle of 51° 09′ and a radius of 37.24 feet for the distance of 33.25 feet to a point of tangent; thence by a line tangent to said curve north 74° 20′ west for the distance of 139.19 feet to a point of curve; thence by the arc of a circle having a central angle of 35° 48′ and a radius of 62.4 feet for the distance of 38.99 feet to a point of tangent; thence by a line tangent to said curve south 69° 52′ west for the distance of 61.67 feet to a point; thence north 23° 12′ west for the distance of 280.15 feet to a point on the southerly line of Fifth avenue; thence along said line north 69° 52′ east for the distance of 20.02 feet to the place of beginning, as shown on a plan hereto attached.

Section 2. That the grade of the north and east building lines shall begin on the south curb line of Fifth avenue at an elevation of 247.80 feet, curb as set; thence rising at the rate of 5.7 per cent. for the distance of 10.02 feet to the south building line of Fifth avenue to an elevation of 248.37 feet; thence rising at the rate of 12.8 per cent. for the distance of 222.53 feet to a point of curve to an elevation of 276.85 feet; thence by a convex parabolic curve for the distance of 40 feet to a point of tangent to an elevation of 281.40 feet; thence rising at the rate of 9.95 per cent. for the distance of 65.54 feet to a point of curve to an elevation of 287.92 feet; thence by a concave parabolic curve for the distance of 40 feet to a point of tangent to an elevation of 292.25 feet; thence rising at the rate of 11.7 per cent. for the distance of 216.97 feet to a point of curve to an elevation of 317.64 feet; thence by a convex parabolic curve for the distance of 200 feet to a point of tangent to an elevation of 332.08 feet; thence rising at the rate of 2.74 per cent. for the distance of 101.97 feet to a point of curve to an elevation of 334.87 feet; thence by a convex parabolic curve for the distance of 50 feet to a point of tangent to an elevation of 334.98 feet; thence falling at the rate of 2.3 per cent. for the distance of 40.96 feet to a point to an elevation of 334.04 feet.

Section 3. The Department of Public Works is hereby authorized and directed to cause said Maple Heights road, from Fifth avenue through properties of George T. Oliver, Henry Aiken, Mary D. Oliver and Rebecca B. Berger, to be opened, in conformity with the provisions of Section 1 of this Ordinance.

Section 4. The cost, damages and expenses caused thereby, and the benefits to pay the same, shall be assessed against and collected from properties benefited thereby, in accordance with the provisions of the Acts of Assembly of the Commonwealth of Pennsylvania relating thereto and regulating the same.

Section 5. That any Ordinance or part of Ordinance conflicting with the provisions of this Ordinance be and the same is hereby repealed, so far as the same affects this Ordinance.
