AN ORDINANCE—Authorizing the opening of Bigelow street, from Hazelwood avenue to Kaercher street, and the assessment of damages caused by the grade of the same.
Section 1. Be it ordained and enacted by the City of Pittsburgh in Select and Common Councils assembled, and it is hereby ordained and enacted by the authority of the same, That Bigelow street, from Hazelwood avenue to Kaercher street, be and the same is hereby opened along the following lines:
The north 5-foot line shall begin at a stone monument on the north 5-foot line of Hazelwood avenue at the first angle in said avenue west from Frank street; thence deflecting 6° 42′ to the left for the distance of 769.73 feet to the west building line of Graphic street; thence deflecting 0° 04′ to the right for the distance of 484.29 feet to the east building line of McCaslin street; thence deflecting 4° 26′ to the right for the distance of 873.86 feet to a point 13.50 feet west from the east 5-foot line of Lydia street; thence deflecting 38° 40′ 45″ to the right for the distance of 1,053.86 feet to the east 5-foot line of Gladstone street, 50 feet wide; thence south by the said east 5-foot line of Gladstone street, 50 feet wide, for the distance of 14.65 feet to a point; thence deflecting 141° 10′ to the right for the distance of 1,128.60 feet to a point; thence deflecting 32° 05′ 35″ to the right for the distance of 370.47 feet to the west 9-foot (curb) line of Kaercher street which it intersects at the angle of 85° 19′ and the north building line of Bigelow street shall be at the perpendicular distance of 5 feet from and parallel to the herein described north 5-foot line, from Hazelwood avenue to Kaercher street, and the south building line of Bigelow street shall be at the perpendicular distance of 45 feet from and parallel to the herein described north 5-foot line, from Hazelwood avenue to the east side of Gladstone street, and the south building line shall be at the perpendicular distance of 35 feet from and parallel to the herein described north 5-foot line, from the west side of Gladstone street to Kaercher street.
Section 2. The Department of Public Works is hereby authorized and directed to cause to be surveyed and opened said Bigelow street, from Hazelwood avenue to Kaercher street.
Section 3. The damages caused thereby and the damages caused by the grade thereof and the benefits to pay the same to be assessed against and collected from properties specially benefited in accordance with the provisions of the Acts of Assembly of the Commonwealth of Pennsylvania relating thereto and regulating the same.
Section 4. That any Ordinance or part of Ordinance conflicting with the provisions of this Ordinance be and the same is hereby repealed, so far as the same affects this Ordinance.
