AN ORDINANCE—Authorizing the opening of Marlborough avenue from Murray avenue to Shady avenue, and the assessment of damages caused by the grade of the same.
Whereas, It appears by the petition and affidavit on file in the office of the City Clerks that a majority of property owners in interest and number abutting upon the line of Marlborough avenue between Murray avenue and Shady avenue have petitioned the Councils of the City of Pittsburgh to enact an ordinance for the opening of the same; therefore,
Section 1. Be it ordained and enacted by the City of Pittsburgh in Select and Common Councils assembled and it is hereby ordained and enacted by the authority of the same, That Marlborough avenue from Murray avenue to Shady avenue be opened to a width of 50 feet, in accordance with an ordinance locating the same, approved June 27, 1901.
Sec. 2. The Department of Public Works is hereby authorized and directed to cause to be surveyed and opened said Marlborough avenue from Murray avenue to Shady avenue.
Sec. 3. The damages caused thereby and the damages caused by the grade thereof and the benefits to pay the same, to be assessed against and collected from properties specially benefitted, in accordance with the provisions of the Acts of Assembly of the Commonwealth of Pennsylvania relating thereto and regulating the same.
Sec. 4. That any ordinance or part of ordinance, conflicting with the provisions of this ordinance, be and the same is hereby repealed so far as the same affects this ordinance.
