AN ORDINANCE—Authorizing the acceptance of the grading, paving and curbing of the sidewalks laid thereon and the sewers constructed therein on the following avenues, streets and alleys, as laid out in the Homewood Driving Park plan of lots, approved March 16th, 1899, and declaring the same to be public improvements of the City of Pittsburgh: Frankstown avenue, Idlewild street, Baxter street, Race street, Monticello street, Hermitage street, Kedron avenue, Upland street, Mt. Vernon street, Homewood avenue, Sterrett street, Collier street, Park street, Forest alley, Fielding alley, Fuchsia alley and Fletcher alley.
Whereas, the owners of the property known as the Homewood Driving Park plan of lots, approved March 16th, 1899, have at their own cost and expense graded, paved, curbed and laid sidewalks thereon and constructed sewers therein on the various avenues, streets and alleys as laid out in said plan; and
Whereas, It appears by the petition and affidavit on file in the office of the City Clerk, the owners of the property known as the Homewood Driving Park plan of lots have petitioned the Councils of the City of Pittsburgh praying that the said improvements in said avenues, streets and alleys be accepted and taken charge of as other public improvements of the city, under the conditions set forth in said petition.
Section 1. Be it ordained and enacted by the City of Pittsburgh, in Select and Common Councils assembled, and it is hereby ordained and enacted by the authority of the same, That the improvements on the avenues, streets and alleys herein specified (said streets having been laid out in the Homewood Driving Park plan of lots, dedicated to public use and approved March 16th, 1899), as made by the owners of the property abutting thereon, at their own cost and expense, namely:
Frankstown avenue (northerly side), between Homewood avenue and 336 feet east of Park street, graded, paved, curbed and sidewalks laid thereon.
Idlewild street, between Lang avenue and Park street, graded, paved, curbed and sidewalks laid thereon.
Baxter street, between Park street and a point 241 feet east of Park street, graded, paved, curbed and sidewalks laid thereon and sewers constructed in the north sidewalk.
Race street, between Lang avenue and a point 191 feet east of Park street, graded, paved, curbed and sidewalks laid thereon.
Monticello street, between Lang avenue and a point 663 feet east of Collier street, graded, paved, curbed and sidewalks laid thereon.
Hermitage street, between Lang avenue and Brushton avenue, graded, paved, curbed and sidewalks laid thereon and sewers constructed in the north sidewalk.
Kedron avenue, between Sterrett street and a point 24 feet east of Lang avenue, graded, paved, curbed and sidewalks laid on the north side, between Sterrett street and a point 24 feet east of Lang avenue, and on the south side between Sterrett street and a point 319 feet west of Homewood avenue.
Upland street, between Lang avenue and a point 718 feet east of Lang avenue, graded, paved, curbed and sidewalks laid thereon and sewers constructed in the north and south sidewalks.
Mt. Vernon street, between Lang avenue and Homewood avenue, graded, paved, curbed and sidewalks laid thereon and sewers constructed in the north and south sidewalks.
Homewood avenue; between Frankstown avenue and Mt. Vernon street, graded, paved, curbed and sidewalks laid thereon.
Sterrett street, between Frankstown avenue and Kedron avenue, graded, paved, curbed and sidewalks laid thereon.
Collier street, between Frankstown avenue and Hermitage street, graded, paved, curbed and sidewalks laid thereon.
Park street, between Frankstown avenue and Race street, graded, paved, curbed and sidewalks laid thereon and sewers constructed therein.
Forest alley, between Lang avenue and a point 300 feet east of Park street, 12 inch pipe inch pipe sewer [sic] constructed therein.
Fielding alley, between Lang avenue and Park street, 12 inch pipe sewer constructed therein.
Fuchsia alley, between Lang avenue and a point 700 feet east of Collier street, 12 inch pipe sewer constructed therein.
Fletcher alley, between Lang avenue and Brushton avenue, 12 inch pipe sewer constructed therein.
Race street, between Park street and 190 feet east of Park street, 12 inch pipe sewer constructed in the north sidewalk.
Monticello street, between Sterrett street and 663 feet east of Collier street, 12 inch pipe sewer constructed in the north sidewalk.
Kedron avenue, between Lang avenue and Sterrett street, 12 inch pipe sewer constructed in the north and south sidewalks.
Collier street, between Forest alley and Idlewild street and between Fielding alley and Race street and between Fuschia [sic] alley and Monticello street, 12 inch pipe sewer constructed between said points.
Homewood avenue, between Fielding alley and Race street and between Fuschia [sic] alley and Monticello street and between Hermitage street and Mt. Vernon street, 12 inch pipe sewer constructed between said points.
Sterrett street, between Frankstown avenue and Monticello street, 12 inch pipe sewer constructed therein.
Be and the same are hereby accepted and declared to be public improvements of the city, and the Department of Public Works is hereby authorized and directed to treat them as other improved public highways of the City of Pittsburgh. The said avenues, streets and alleys being fully shown, marked and designated on a plan of the Homewood Driving Park plan of lots, a copy of which is hereto attached and made part of this ordinance.
Sec. 2. That any ordinance or part of ordinance conflicting with the provisions of this ordinance be and the same is hereby repealed so far as the same affects this ordinance.
