AN ORDINANCE—Authorizing the vacation of Fairfax street, between Homewood avenue and Dunfermline street (or alley).

Section 1. Be it ordained and enacted by the City of Pittsburgh in Select and Common Councils assembled, and it is hereby ordained and enacted by the authority of the same, That Fairfax street, from Homewood avenue to Dunfermline street (or alley), as laid out in Mellon Brothers' Homewood plan of lots, at a width of forty (40) feet, and recorded in the Recorder's office of Allegheny county, in Plan Book vol. 3, page 270, shall be and the same is hereby vacated.

Sec. 2. This ordinance shall be accepted and construed in harmony with and as based upon the petition and agreement of the owners of property abutting upon the said vacated street, as the same appears of record in the office of the City Clerk.

Sec. 3. That any ordinance or part of ordinance conflicting with the provisions of this ordinance be and the same is hereby repealed so far as the same affects this ordinance.
