G. & G. H. Shoenberger vs. John L. Miller & Co. Reported yesterday. Jury found verdict for pltffs. for $1,721 04.
Rev. Isaac Williams vs. African M. E. Church. Action to recover $255, a balance of salary for the last conference year. Jury out.
Ann Prenter, widow of Wm. Prenter vs. Pennsylvania Railroad company. The facts of the case appear to be these: Mrs. Ann Prenter, widow of William Prenter, deceased, brings action against the Pennsylvania Railroad company to recover damages for his death on the road in March, 1855. He was employed on the road as a brakesman on a freight train, and when going eastward, stopped at Denny's station, on a sideing [sic], to let the passenger train, coming west, pass by. While at this point he attempted to walk over an uncovered culvert, and, in doing so, fell a distance of ten or twelve feet and was injured to such an extent, that he died a short time afterwards in the city of Pittsburgh. The culvert was eight feet in width, and is said to have been constructed in the ordinary way, and Mr. Prenter well acquainted with it, having been an employee of the Company some three months previously. It is alleged by the plaintiff that it was left in such an insecure condition that it was extremely hazardous to cross over it; and the Company is now liable for the damage which Mrs. Prenter sustained by the death of her husband.
